Consultation on the output of the Mental Capacity Act 2005, Deprivation of Liberty Safeguards Return (DoLS) implemented in 2013-2014

What is this consultation?

This consultation invites responses on the proposed output of the revised Mental Capacity Act 2005, Deprivation of Liberty Safeguards Return (DoLS) for 2013-2014.

We propose to review the way in which data is reported, and obtain information about what type of data and reporting formats you find useful and beneficial.

Why are we having this consultation?

We are consulting users following changes made to the Social Care data collections as a result of the Zero Based Review (ZBR). The ZBR recommended the revision of the Mental Capacity Act 2005, Deprivation of Liberty Safeguards Return (DoLS), which is now an annual return at case level. The first submission of the revised DoLS data to the HSCIC will occur in May 2014 and this data will be reported for the first time over the the next few months. We want to ensure that the data collection continues to be relevant and meaningful to the people who use it, and that we are meeting your information and data needs in the best and most cost-effective way. Your comments will be considered against resource pressures.

How to respond

This consultation process is open to both individuals and organisations. If you provide contact details (name, email, organisation) it will allow us to follow up with any questions that arise from your response and notify you of the outcome. It is, however, entirely optional.

The findings from the consultation exercise will be published on our website at in May 2014.

The information you send us may be passed to colleagues within the HSCIC, other government departments or related agencies. Even where confidentiality is requested, if a request for disclosure of the consultation response is made in accordance with the Freedom of Information legislation, and the response is not covered by one of the exemptions in the legislation, the HSCIC may have to disclose the response, in whole or in part.
